Early-access terms for using Detegere

Early-access notice: These Terms describe the current rules for accessing and using Detegere. They are intended for early access and product evaluation. Formal commercial agreements — including payment terms, liability caps, indemnity, and governing law — will require legal review before paid customer contracts. These Terms may be supplemented or replaced by order-specific commercial terms.

1. Acceptance of Terms

By accessing or using Detegere, you agree to these Terms of Use and our Privacy Notice. If you are using Detegere on behalf of a company or organization, you confirm that you are authorized to act for that organization and that the organization accepts these Terms.

If you do not agree to these Terms, do not use the service.

2. About Detegere

Detegere is an Operational Intelligence Platform for manufacturing teams. It connects warning signs, operational context, root-cause investigation, action tracking, reporting, and organizational learning to help teams see what changed, why it matters, what was tried, and what should be remembered.

3. Early Access Status

Detegere is currently in early access. During this period:

  • Features may be added, modified, limited, or removed
  • Service availability and performance may vary
  • Functionality referenced in public materials may still be in development
  • Feedback provided during early access may be used to improve the product
  • Pricing and terms may evolve as the product reaches general availability

4. Account Responsibilities

You are responsible for:

  • Providing accurate information when creating an account
  • Keeping your login credentials secure
  • Ensuring only authorized users access your organization's account
  • Notifying us promptly if you suspect unauthorized access to your account
  • Managing user roles and access within your organization
  • All activity that occurs under your account

5. Customer Data Ownership

Your operational data — including uploaded datasets, KPI configurations, facility structures, events, improvements, and reports — remains your data. Detegere processes it solely to provide the service.

By uploading data to Detegere, you confirm that:

  • You have the right and authority to upload and process that data
  • The data does not violate any applicable laws or third-party rights
  • You are responsible for the accuracy and legality of what you upload

Our Privacy Notice governs how personal information is handled. Data deletion and export tools are under active development — contact us through the Contact page to discuss data return or deletion.

6. Operational Decision-Support

Detegere provides operational intelligence and decision-support. It does not replace plant leadership, engineering judgment, maintenance procedures, safety procedures, regulatory requirements, or professional advice.

Specifically:

  • Detegere is not a safety-critical control system
  • Detegere does not control equipment, processes, or production lines
  • You remain responsible for all operational decisions and actions taken
  • You must independently assess Detegere outputs before acting on them
  • Detegere does not provide engineering, legal, safety, or regulatory advice

7. Analytics and Insight Limitations

Detegere may surface patterns, statistical relationships, anomalies, risk indicators, forecasts, and operational evidence. These outputs:

  • Are not guaranteed proof of cause or effect
  • Depend on the quality, completeness, and configuration of data you provide
  • May not reflect all relevant operational factors
  • Should be validated by qualified personnel before action is taken

Detegere helps you see what your data suggests. What to do about it remains your judgment.

8. No Guaranteed Business Outcome

Detegere is designed to support better decisions, not guarantee a specific result. We do not guarantee:

  • Cost savings or EBITDA improvement
  • Uptime or downtime reduction
  • Throughput or production output changes
  • Waste or quality improvement
  • Root-cause certainty
  • Regulatory compliance or safety results
  • Any specific operational or financial outcome

Results depend on how the product is configured, the quality and completeness of data uploaded, and the judgment of the people using it.

9. Acceptable Use

You must not:

  • Use the service for any unlawful purpose
  • Attempt to bypass authentication or access another organization's data
  • Upload malware, harmful code, or content that violates applicable law
  • Interfere with or disrupt the service or its underlying infrastructure
  • Abuse or overload public endpoints or rate limits
  • Use Detegere as a safety-critical or automated control system
  • Use the product in a way that violates another party's rights
  • Share access credentials with unauthorized individuals

10. Availability and Changes

We do not guarantee uninterrupted availability. The service may be unavailable during maintenance, due to infrastructure issues, or for other operational reasons. Early-access features may change, be removed, or behave differently from what is described in public materials.

Detegere may suspend or terminate access where there is serious misuse, security risk, unlawful activity, or breach of these Terms.

11. Fees and Pricing

Pricing information is published on the Pricing page. Detailed payment terms — including invoicing, taxes, renewal, cancellation, and payment mechanics — will be defined in the applicable order form or subscription agreement for each customer engagement.

12. 90-Day Refund Guarantee

Detegere offers a 90-Day Full Refund Guarantee intended to reduce early-adoption risk. The guarantee is designed around the principle that if Detegere does not help your team uncover meaningful operational opportunities, you should not pay for it.

Important boundaries:

  • The guarantee does not promise a specific financial outcome or savings amount
  • Eligibility, timeframe, and request process will be defined in your order agreement
  • The guarantee requires good-faith use of the product during the period
  • Final guarantee terms are subject to business and legal finalization before paid launch

13. Privacy

Our Privacy Notice is incorporated into these Terms and describes how we collect, use, and handle personal information and customer operational data.

14. Third-Party Services

Detegere relies on third-party infrastructure and service providers to operate. Service availability may be affected by those providers. Where users use third-party integrations directly, the terms of those providers may apply.

15. Intellectual Property

Detegere owns the platform, software, design, and product materials. You receive a limited right to use the service according to these Terms. You retain full ownership of your customer data. Feedback you provide may be used to improve the product without transferring ownership of your data.

16. Disclaimers

Detegere is provided on an early-access, as-available basis. We do not warrant that the service will be uninterrupted, error-free, or that outputs will be accurate or complete. Outputs depend on the data and configuration you provide.

The platform is a decision-support tool. You bear responsibility for evaluating its outputs and for the decisions and actions you take based on them.

17. Limitation of Liability

Pending legal review. This section is a placeholder. Before paid customer contracts, formal limitation of liability language — including treatment of indirect and consequential damages, production losses, data loss, service interruptions, and a liability cap — will be finalized by legal counsel. These terms will apply to the extent permitted by applicable law.

In the meantime: Detegere's outputs are for decision-support. You are responsible for the decisions and actions you take. We are not responsible for production losses, safety incidents, operational failures, or financial outcomes that result from relying on Detegere outputs.

18. Governing Law and Disputes

Governing law, jurisdiction, and dispute resolution terms will be finalized before paid customer contracts. Paid agreements may include order-form-specific legal terms that supplement or replace this section.

19. Changes to These Terms

These Terms may be updated as the product evolves. The "Last updated" date at the top of this page reflects the most recent revision. We will communicate material changes through reasonable means.
